Penmark Terms of Service

These plain-English MVP terms describe permitted use of Penmark. They are not legal advice.
MVP draft: do not use real student data without school approval. Use anonymized samples for demos whenever possible.
Acceptance
By accessing or using Penmark, you agree to these Terms. If you use Penmark for a school or organization, you are responsible for confirming that you are authorized to do so.
What Penmark Does
Penmark compares a new writing submission with prior writing samples and provides a writing-consistency report for teacher review.
The MVP may support browser-based demo storage and an optional private explanation of the report, depending on how it is configured.
Decision-Support Disclaimer
Penmark is a decision-support tool. It does not prove misconduct, plagiarism, writing source, or any other violation.
Penmark must not be used as the final disciplinary system. A qualified teacher or responsible adult should review the report, context, and student response before taking action.
User Responsibilities
You are responsible for entering only information you are authorized to use, including student names, writing samples, new submissions, feedback, and optional email addresses.
Teachers, schools, and organizations are responsible for required notices, permissions, internal approvals, retention decisions, and appropriate use of student information.
Prohibited Uses
Do not use Penmark to harass, profile, or unfairly target students or other people.
Do not use Penmark as the sole basis for discipline, grading penalties, academic integrity findings, or other high-impact decisions.
Do not enter information you are not authorized to use, attempt to bypass security controls, interfere with service operation, or use Penmark for unlawful purposes.
Accuracy Disclaimer
Penmark reports may be incomplete, inaccurate, or affected by short samples, unusual assignments, editing help, accessibility tools, language development, or other context.
You are responsible for independently reviewing results before relying on them.
No Legal Or Educational Advice
Penmark does not provide legal, educational, disciplinary, or compliance advice. Consult qualified counsel and appropriate school leadership before production use or formal deployment.
Intellectual Property
Penmark and its software, design, reports, and related materials are owned by Penmark or its licensors.
You retain responsibility for the content you enter and must have the rights or authorization needed to use it.
Availability
Penmark may change, pause, or stop features at any time. Demo functionality may be unavailable, reset, or changed without notice.
Limitation Placeholder
To the fullest extent allowed by applicable law, Penmark's liability is limited as described in the final production agreement or policy adopted before launch. This MVP draft should be reviewed by counsel before production use.
